1. Operator and agreement
Verdary is operated by Nikolay Boyukliev, Bulgaria. Questions about these terms can be sent to nboukliev@gmail.com.
By signing in to or using Verdary, you agree to these terms and the Privacy Policy. If you do not agree, do not use the service.
2. The service
Verdary provides a private gardening diary for organizing gardens, planters, tracked plants, dated records, notes and photos. It may also provide optional AI-assisted suggestions based on photos and owner-controlled unlisted photo-gallery links. The current service is provided without a subscription charge.
3. Account eligibility and security
Verdary does not impose a separate age minimum. You must, however, be legally able to agree to these terms and to use the Google account through which you authenticate. If applicable law requires authorization from a parent or guardian, you may use Verdary only with that authorization and supervision.
You are responsible for maintaining the security of your Google account and for activity performed through your Verdary account. Notify the operator promptly if you believe your account has been accessed without authorization.
4. Your content
You retain ownership of the notes, photos and other content you submit. You grant the operator a limited, non-exclusive right to host, copy, process, transform and display that content only as needed to operate, secure, back up and improve the user-facing Verdary service.
You must have the rights and permissions needed for content you upload. Do not submit unlawful content, infringe intellectual-property or privacy rights, expose confidential information without authority, or upload malicious files. Garden members you authorize may be able to view or change shared garden content according to their assigned role.
If you enable a public gallery, you instruct Verdary to make its photos, record titles and activity dates available to anyone possessing the link. You are responsible for having permission to share that material and for choosing recipients appropriately. Public links can be forwarded by recipients; disable or replace a link when it should no longer be used.
5. Acceptable use
You must not:
- Attempt to access another user's account, garden or private photos without authorization.
- Circumvent security controls, probe the service for vulnerabilities without permission, or disrupt its operation.
- Use Verdary to distribute malware, unlawful material, spam or abusive content.
- Use automated traffic in a way that creates unreasonable load or interferes with other users.
- Misrepresent your identity or use the service in violation of applicable law.
6. AI-assisted suggestions
Photo analysis and plant-chat answers can be incomplete, uncertain or wrong. You remain responsible for reviewing all suggested plant identities, observations, diary text and plant-detail changes before saving or acting on them. Suggestions are not professional horticultural, medical, chemical, environmental or safety advice. Do not rely on them where an error could harm a person, animal, plant or property.
A tracked plant has one shared conversation visible to that garden's members. Owners and editors may add messages; viewers have read-only access. Verdary sends relevant plant, diary, recent conversation and current-turn photo context to OpenAI when chat is used. Clearing a chat does not remove its photo diary events. Deleting a tracked plant removes its conversation while preserving existing diary records and photos.
7. Third-party services
Verdary relies on services supplied by Google, Supabase, Hetzner and, when optional AI features are used, OpenAI. Availability may be affected by those providers, and their own terms and privacy notices also apply to their direct relationship with you or the operator.
8. Availability and changes
The operator aims to keep Verdary available and protect stored content, but uninterrupted or error-free operation is not guaranteed. Features may be corrected, updated, limited or discontinued. Reasonable notice will be given before material changes when practicable. Keep independent copies of content that is important to you.
9. Suspension, termination and deletion
Access may be suspended or terminated when reasonably necessary to protect Verdary or its users, address unlawful or abusive activity, comply with law, or respond to a serious breach of these terms. You may stop using Verdary at any time. To request deletion of your account and associated personal data, email nboukliev@gmail.com from your account email address.
10. Disclaimers and responsibility
Verdary is provided on an “as available” basis. To the maximum extent permitted by law, the operator does not promise that every feature, identification, suggestion or stored item will always be accurate, available or free from loss. Nothing in these terms excludes liability that cannot lawfully be excluded, or limits mandatory consumer rights.
To the extent permitted by law, the operator is not responsible for indirect or consequential loss arising from use of, or inability to use, the service. You remain responsible for gardening decisions and for maintaining copies of irreplaceable content.
11. Governing law and disputes
These terms are governed by Bulgarian law, without depriving consumers of mandatory protections available under the law of their country of residence. Please contact the operator first so an issue can be resolved informally. Courts and authorities with jurisdiction under applicable law remain available.
12. Changes to these terms
These terms may be updated as Verdary changes. The effective date above will be revised, and material changes will be communicated through the service when reasonably possible. Continued use after updated terms take effect constitutes acceptance where permitted by law.
